Terms of service

These terms govern the sale of goods through rushmuseum.art. Please read them before placing an order.

Rush Museum is a trading name of Francisco José Domínguez Fernández, NIF 28649351E, Calle Cerro de la Atalaya 24, 41089 Quinto, Dos Hermanas, Seville, Spain. Email: hola@rushmuseum.art.

These terms apply alongside our Shipping policy, our Refund policy and our Privacy policy, which form part of your contract with us.

Nothing in these terms limits or excludes any right you have by law as a consumer.

1. Who can order

You may place an order if you have the legal capacity to enter into a contract.

Most of what follows assumes you are buying as a consumer, meaning for purposes outside your trade or profession. Where a provision applies only to consumers, or only to business customers, this is stated.

2. Our products

We publish and sell photography books and PSM, our periodical publication. All titles are our own editions.

Print runs are limited and titles are not usually reprinted. When an edition sells out, it is gone.

We take care that product descriptions, dimensions and photographs are accurate. Even so, printed materials vary: paper tone, ink density and binding can differ slightly between copies and from what a screen displays. Minor variation of this kind is a characteristic of the medium and not a defect.

Some items are offered from previous editions or remaining stock. Where such a copy shows shelf wear or any other imperfection, we describe it on the product page before you buy.

3. Prices

Prices are shown in euros and include any applicable VAT. The price you see is the price you pay us.

Where your delivery address is outside the European Union, customs duties, import taxes and clearance fees may be charged in your country. These are not included in our price and are payable by you. Section 5 of our Shipping policy explains this.

We may change prices at any time, but a change never affects an order we have already accepted.

4. How an order becomes a contract

  1. Adding items to your cart and completing checkout constitutes an offer to buy.
  2. We will send you an order confirmation by email. This acknowledges that we have received your order; it is not yet our acceptance of it.
  3. The contract is formed when we send you a dispatch confirmation.

Payment is taken when you place your order. If we do not accept your order, we refund you in full.

We may decline an order where the item is no longer available, where a price or description was published in error, where we are unable to ship to your address, or where we have reasonable grounds to believe the order is fraudulent. If a pricing error is obvious and you could reasonably have recognised it as such, we are not obliged to supply at the incorrect price.

5. Payment

We accept the payment methods shown at checkout. Payments are processed by our payment providers; we do not receive or store your full card details at any point.

6. Delivery

Delivery times, destinations and the treatment of customs charges are set out in our Shipping policy.

Risk of loss or damage passes to you when you, or a third party you designate other than the carrier, take physical possession of the goods.

7. Cancellation, withdrawal and returns

Your right to cancel before dispatch, your right of withdrawal, and what happens if goods arrive damaged or defective are set out in our Refund policy.

You can exercise your right of withdrawal directly using the withdrawal function at rushmuseum.art/pages/right-of-withdrawal.

8. Accounts and restricted areas

You can order without creating an account. If you choose to sign in, access is by a code sent to your email address, and you are responsible for keeping access to that mailbox secure.

Please keep the information on your account accurate, particularly your delivery address.

Parts of this website are available only to certain customers. We decide who has access, and access is a courtesy rather than an entitlement. We may grant or withdraw it at our discretion. Any purchase made in a restricted area is governed by these terms in exactly the same way as any other purchase.

9. Using this website

You may browse, read and share our content for personal, non-commercial purposes.

You may not copy, reproduce, redistribute or exploit commercially any photographs, book designs, layouts, texts or other material from this site without our prior written consent. All such material, and the Rush Museum name and marks, belong to us or are used with permission.

Please do not attempt to interfere with the operation or security of the site, or use it in any unlawful way.

10. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care.

We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for your statutory rights as a consumer.

We are not responsible for interruptions, errors or unavailability of the website itself, or for content on any external site we link to.

If you are a business customer, our total liability in connection with any order is limited to the amount you paid for that order.

11. Changes to these terms

We may update these terms. The version that applies to your purchase is the one published when you placed your order, and later changes do not affect orders already accepted.

Changes take effect when published on this page, and the date at the foot of this page tells you when we last revised them.

12. Governing law and where disputes are heard

These terms are governed by Spanish law.

If you are a consumer resident in the European Union, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your own country. We will only bring proceedings against you in the courts of the country where you live.

If you are a business customer, the courts of Seville, Spain, have exclusive jurisdiction.

13. Language

These terms are published in English and Spanish. Both versions are equally valid. If you are a consumer resident in Spain, the Spanish version prevails in the event of any discrepancy.

14. Complaints

Write to us at hola@rushmuseum.art. We normally reply within two working days, and in any event within fourteen days.

We are not adhered to any alternative dispute resolution body and we handle complaints directly. If you are a consumer resident in the European Union, you can seek assistance from the European Consumer Centre in your country.
